International Customs, Duties & Taxes

When ordering from BoutiqueBelleMia.com, you are responsible for assuring the product can be lawfully imported to the destination country.

The recipient is the importer of record and must comply with all laws and regulations of the destination country. Orders shipped outside of Canada may be subject to import taxes, customs duties and fees levied by the destination country. The recipient of an international shipment may be subject to such import taxes, customs duties and fees, which are levied once a shipment reaches the recipient’s country. Additional charges for customs clearance must be borne by the recipient; we have no control over these charges and can’t predict what they may be. Customs policies vary widely from country to country; you should contact your local customs office for more information. When customs clearance procedures are required, it can cause delays beyond our original delivery estimates.

Notes:

  • Cross-border shipments may be opened and inspected by customs authorities.
  • We may provide certain order, shipment, and product information, such as titles, to our international carriers, and such information may be communicated by the carriers to customs authorities in order to facilitate customs clearance and to comply with local laws.

U.S. Orders – Duty Prepayment and Return Policy (Effective August 29, 2025)

Executive Summary

All orders shipped to the United States require duties to be prepaid by Boutique Belle Mia prior to importation. Orders are considered final sale, and exchanges are not permitted. Only new, unworn items returned in original packaging and meeting all conditions outlined in the Return Policy may be eligible for a refund. Although Boutique Belle Mia is obligated to prepay duties under United States import regulations, the financial liability for these duties remains with the customer. These charges are imposed by the United States government and are directly attributable to the customer's purchase.

Legal Basis

In accordance with the Executive Order issued by United States President Donald J. Trump, shipments entering the United States with a declared value under eight hundred United States dollars, which were previously exempt from duties, must now have all applicable duties prepaid prior to importation. Boutique Belle Mia complies fully with this mandate.

Terms Applicable to All United States Orders

1. Final Sale and Returns

  • All orders shipped to the United States are considered final sale. Exchanges are not permitted.
  • Only new, unworn items returned in original packaging and meeting all conditions outlined in the Return Policy may be eligible for a refund.
  • In such cases, all duties and related fees prepaid by Boutique Belle Mia, as required by United States Customs, will be deducted from any refund amount.
  • Duty fees typically begin at thirty-five percent of the item's purchase price and may vary based on product classification, declared value, and applicable United States Customs assessments.

2. Customer Acknowledgment

By placing an order for delivery within the United States, customers expressly acknowledge and agree to the following:

  • (i) All duties are prepaid by Boutique Belle Mia on the customer's behalf prior to importation, in accordance with United States Customs requirements.
  • (ii) All orders are final sale, and any prepaid duties will be deducted from an eligible refund in the event of a return.

This acknowledgment constitutes a binding waiver of any right to dispute duty-related deductions through financial institutions or payment platforms. Customers further agree not to initiate chargebacks, claims, or disputes with their credit card provider, PayPal, or any other payment platform regarding the deduction of duties. Customers affirm that these duties are imposed by the United States government and are financially attributable to their purchase.

Compliance Statement

This policy is mandatory in order to ensure compliance with United States Customs and Border Protection regulations and to maintain uninterrupted service for clients located within the United States.

Governing Law and Jurisdiction

This policy and any disputes arising from it shall be governed exclusively by the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any legal proceedings, claims, or actions shall be brought solely before the courts located in Montreal, Quebec, Canada, and customers irrevocably submit to the jurisdiction of those courts.

Conflict of Laws

The parties expressly agree that the laws of the Province of Quebec and the federal laws of Canada applicable therein shall govern this policy and any related transactions, without regard to any conflict of law principles that would result in the application of the laws of another jurisdiction.

 

This Agreement, originally written in the English language, shall be governed by the English language. In the event any dispute arises with respect to this Agreement, the meanings of all terms and provisions of this Agreement shall be interpreted in their original English form.
